COMBINED NOTICE OF FINDING OF NO SIGNIFICANT
IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but
related procedural requirements for activities to be undertaken by
the City of Toledo.
REQUEST FOR RELEASE OF FUNDS
On or after April 1, 2026, the City of
Toledo will authorize the Lucas Metropolitan Housing Authority to
submit a request to the United States Department of Housing and
Urban Development, Cleveland Office of Public Housing for the
release of Capital and Operating Program funds under Sections
9(d)(1) and 9(e)(1) of the United States Housing Act of 1937, as
amended, for the following projects:
PROJECT: ER-3—Birmingham Terrace,
Ravine Park Village, & Scattered Sites
PURPOSE: The project site consists of
two multi-family residential facilities (Ravine Park Village and
Birmingham Terrace) and five single-family and duplex properties
located in the City of Toledo, Ohio. This review is being submitted
to satisfy the PHA five-year environmental review requirements for
repair and modernization activities for the years 2025-2029. Refer
to the ER3 Project Description uploaded below for additional
property information and a complete list of the activities
contemplated. Additionally, LMHA contemplates disposition of the
Ravine Park Village, Birmingham Terrace, and the scattered sites
within the 5-Year clearance period through the Section 18, Section
22, or the Rental Assistance Demonstration (RAD) program, or
combination thereof, process. Site re-use is anticipated to be as
rental housing regardless of the method of disposition.
Furthermore, the project does not involve new construction,
substantial rehabilitation, expansion of a building’s
footprint, or changes to the existing unit count.

FINDING OF NO SIGNIFICANT IMPACT
The City of Toledo, Department of Housing
and Community Development (DHCD), has determined that the proposed
housing projects will have no significant impact on the
environment. Therefore, an Environmental Impact Statement under the
National Environmental Policy Act (NEPA) of 1969 is not required.
An Environmental Review Record (ERR) that documents the
environmental determinations for this program is on file at City of
Toledo, Department of Housing and Community Development. The ERR
will also be made available to the public for review
electronically. Please submit your request to
andrew.sager@toledo.oh.gov on weekdays between the hours of 8:30
a.m. to 3:30 p.m.
PUBLIC COMMENTS
Any individual, group, or agency may submit
written comments on the ERR to the City of Toledo, Department of
Housing and Community Development. All comments received by March
31, 2026, will be considered by the City of Toledo prior to
authorizing submission of a Request for Release of Funds and
Environmental Certification from HUD.
ENVIRONMENTAL CERTIFICATION
The City of Toledo certifies to HUD that
Wade Kapszukiewicz, in his official capacity as Mayor of City of
Toledo, consents to accept the jurisdiction of the Federal Courts
if an action is brought to enforce responsibilities in relation to
the environmental review process and that these responsibilities
have been satisfied. HUD’s approval of the certification
satisfies its responsibilities under NEPA and related laws and
authorities, and allows the City of Toledo to utilize federal funds
to implement the Program.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release
of funds and the City of Toledo certification for a period of
fifteen days following either the anticipated submission date
(cited above) or HUD’s actual receipt of the request
(whichever is later) only if the objections are on one of the
following bases: (a) that the Certification was not executed by the
Certifying Officer of the City of Toledo; (b) the City of Toledo
has omitted a step or failed to make a decision or finding required
by HUD regulations at 24 CFR Part 58; (c) the City of Toledo has
committed funds or incurred costs not authorized by 24 CFR Part 58
before approval of a release of funds by HUD; (d) another Federal
agency acting pursuant to 40 CFR Part 1504 has submitted a written
finding that the project is unsatisfactory from the standpoint of
environmental quality. Objections must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58, Sec.
58.76) and shall be addressed to HUD Public Housing Field Office at
ClevelandPublicHousing@hud.gov. Potential objectors may contact HUD
directly to verify the actual last day of the objection period.
