ORDER AUTHORIZING SERVICE BY PUBLICATION

The Court, having reviewed Plaintiff’s Verified Motion
for an Order Authorizing Service by Publication (Doc. 11), finds
that Plaintiff has demonstrated that Defendant Samar Ramez
Chms-Eddin cannot be located despite reasonable diligence, and that
service by publication is appropriate under Federal Civil Rule
4(e)(1) and Michigan Civil Rule 2.105(J). The Motion is granted as
set forth below.
1.
Parties. On January 7, 2026,
Plaintiff Regions Bank d/b/a Ascentium Capital
(“Plaintiff”) commenced this action by filing a
Complaint against Defendants, Bravada, Inc. and Samar Ramez
Chms-Eddin (“Chms-Eddin”). A copy of the Complaint and

Nature of Action. Pursuant to the
Complaint, Plaintiff seeks to enforce an Equipment Finance
Agreement against Bravada, Inc. and a Personal Guaranty against
Chms-Eddin, as well as recover collateral securing Bravada’s
obligations under the Equipment Finance Agreement.
3.
Where and When to Answer or Respond to
Complaint. Chms-Eddin must file an Answer or other response
to the Complaint (a “Responsive Filing”), including any
motion under Federal Civil Rule 12, on or before the Deadline
(defined below). A Responsive Filing must be filed (a) with the
Clerk of the United States District Court for the Northern District
of Ohio, 1716 Spielbusch Avenue Toledo, Ohio 43604; or (b) pursuant
to the Court’s electronic filing system, information
available at:
https://www.ohnd.uscourts.gov/electronic-filing.
FAILURE TO TIMELY FILE A RESPONSIVE FILING ON
OR BEFORE THE DEADLINE MAY RESULT IN THE ENTRY OF A DEFAULT
JUDGMENT AWARDING THE RELIEF SOUGHT IN THE COMPLAINT.
4.
Publication. Plaintiff shall cause
this Order to be published for three consecutive weeks in the legal
notices sections of The Detroit Free Press and The Blade, and
thereafter file Proof of Service in this action pursuant to
Michigan Civil Rule 2.106(G).
5.
Deadline. The deadline to file the
Responsive Filing is 21 days after the latest of (a) the date of
the third publication of this Order in The Detroit Free Press; (b)
date of the third publication of this Order in The Blade; and (c)
Plaintiff’s filing of the Proof of Service (the
“Deadline”).
6.
Mailing of Order. Before the date
of the last publication of this Order, Plaintiff shall mail a copy
of this Order to Chms-Eddin at the Mead Address (as defined in the
Motion) by (i) regular United States Mail, postage prepaid; and
(ii) registered mail, return receipt requested. Plaintiff shall
file proof of the mailings on the docket.
